These Terms of Use (“Terms”) govern your use of ArkansasBreakingNews.com and the Arkansas Breaking News mobile app (together, the “Service”), operated by Square World Media, LLC (“we,” “us,” or “our”). By using the Service you agree to these Terms.
1. Use of the Service
You may use the Service for personal, non-commercial purposes. You agree not to misuse the Service, interfere with its operation, attempt to access it by automated means beyond normal use, or use it for any unlawful purpose.
2. Content
News articles, summaries, images, and other content are owned by us or our licensors and protected by copyright. You may share links to our content. You may not republish, redistribute, or sell content, including member-only content, without written permission.
3. Members subscription
- What you get. The Members Monthly subscription unlocks the Police Activity feed: hourly summaries of monitored public-safety radio traffic.
- Price and billing. The subscription is $4.99 USD per month (local pricing may vary) and is billed to your Apple ID account through the App Store.
- Automatic renewal. Your subscription automatically renews each month unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
- Managing and cancelling. You can manage or cancel your subscription any time in iOS Settings → your name → Subscriptions. Cancelling stops future renewals; you keep access until the end of the paid period.
- Refunds. Purchases are processed by Apple and are subject to Apple’s refund policies. Request refunds at reportaproblem.apple.com.
- Changes. We may change the price or features of the subscription with notice as required by Apple. Price changes will not affect you until you agree or your subscription renews after the notice period.
4. Police Activity summaries — important notice
Police Activity summaries are generated automatically from publicly broadcast public-safety radio traffic. They are preliminary and unverified. Radio traffic is often incomplete, may be misheard or mis-transcribed, and situations change as they develop. Summaries:
- are provided for general informational purposes only;
- are not official statements from any law-enforcement or public-safety agency;
- should not be relied on for personal safety decisions, legal matters, or any purpose where accuracy is critical;
- may not be redistributed, reposted, or republished.
Call 911 in an emergency. Verify information with the relevant agency before acting on it.
5. Weather
Weather data is provided by Apple Weather and is for general information only. Always follow official warnings from the National Weather Service and local authorities.
6. Push notifications
If you enable notifications, we may send breaking-news alerts. You can turn them off in iOS Settings at any time.
7. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including accuracy, reliability, fitness for a particular purpose, or uninterrupted availability.
8. Limitation of liability
To the fullest extent permitted by law, Square World Media, LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim, or $10 if you have paid nothing.
9. Termination
We may suspend or end your access to the Service if you violate these Terms. You may stop using the Service at any time; cancel any subscription through Apple as described above.
10. Changes to these Terms
We may update these Terms. The effective date will change and continued use of the Service after changes means you accept them.
11. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Bowie County, Texas.
12. Apple-specific terms
The app is distributed through Apple’s App Store. Apple is not a party to these Terms and has no obligation to provide maintenance or support for the app. Apple’s standard Licensed Application End User License Agreement also applies; where it conflicts with these Terms, the EULA controls with respect to Apple.
